I enjoyed reading about the July 10, 1976 "Lost Concert" DVD that was distributed (although I skipped most of all the legalese!). Gene & Paul filed suit in Nov 2003, after the DVD came out in Oct 2003. Who scooped one up? I did. It's black and white footage, but a great historical document of that tour, and they perform "Flaming Youth"! The Mike Douglas show appearance was added as a bonus.

"Plaintiffs KISS Catalog, Ltd., Gene Klein (a.k.a. Gene Simmons), and Paul Stanley have brought anti-bootlegging, copyright, trademark, and related state law claims against Defendants. On July 10, 1976, KISS performed at New Jersey's Roosevelt Stadium as part of its "Spirit of '76" concert tour. John Scher, the President and CEO of Metropolitan Talent, Inc. "Metropolitan", was the concert promoter for the Roosevelt Stadium performance. As part of its services, Metropolitan filmed the Roosevelt Concert so that it could simultaneously project KISS' performance on-screen behind the band while it was onstage. Metropolitan then apparently held on to its recording of the concert for the next thirty years."
